  • Definitely could have been what happened if he wasn't caught. He was in pain after being rejected by her mother and probably angry and drunk. She was way out of her depth and had no idea who she was dealing with.

    Why the fuck are people downvoting you?? You literally just said what the show portrays. He literally almost committed statutory rape and only stopped when he was caught. Why can't people accept Bojack is a God awful person that's fargone from redemption at this point?

    Hold up. BoJack repeatedly rebuffed her advances, telling her she didn't know what she wanted. Telling her to go to bed. She was the one who kept pushing and ultimately came back to the boat.

    Yes, BoJack is a terrible person. But you seemed to have missed parts of that episode. And the later one where he confesses how much that whole thing fucked him up and wondering if he actually would've gone through with it. Then continuing and saying half of himself says he never would, but the other half saying he would've. The whole thing bothered him, a lot.

    Also, it wouldn't have been statutory rape. Penny was 17, and explicitly mentions that's the age of consent in NM AND how she had had nothing to drink at all that night, making it completely legal since she could legally give consent both due to age and her lack of impaired state. Age of consent laws vary state-to-state. Some are 16, some have the weird "with parental consent" attached, and some of those have even lower ages.

    Would it have been immoral? Yes. Would it have been statutory rape? No.
