"Ancient art", in the context of e621, applies to any art made before 1980.

Unfortunately, because copyright laws are a total mess, while the art itself may be public domain the specific digitization might not be (which is very stupid imho)

Depending on country, things don't pass automatically into the public domain until somewhere around 70 years after the creator has died. This means that art after 1931 is potentially still under copyright in the US and many other countries. As currently defined on e621, "ancient" merely means the art predates furry fandom (the start of which is put at 1980 for simplicity's sake). So there's 49 years in which uploaded art can very well still be under copyright.

Truth be told, I would prefer the term get reworked.

I wouldn't be against it if we can find a suitable replacement word for ancient.

How about "pre-fandom"? Not perfect, what with the debate over when the fandom started.

Then we could subdivide into "ancient" "pre-modern" "modern" "contemporary"
Ancient: anything before 476ad
Pre-modern: 477ad - 1849ad
Modern: 1850ad - 1950ad or perhaps 1980 or even 2000
Contemporary: everything after modern
I know that's extremely reductive, but it could be a good place to start and the categories could be further subdivided or renamed as the need arises

Not a fan of labeling art "pre-fandom", or "early fandom", or things like that. As I discussed in a previous thread, it doesn't really describe anything about the art, or its relation to the fandom (or a proto-fandom) itself. It's just an arbitrary time point, which if there should be one around that time, I think a better separation would be around when mass marketed artwork started being a thing in the early 1900s or late 1800s (for reasons mentioned in that thread). Or if wanting something closer, 2000 or 2001 would be better as it also aligns with the end of the 20th_century (which currently excludes the last two decades of the 20th century for some reason).
